What is the process of obtaining a Golden Visa?

Once you opt to invest in Fjord Capital, our Fund Manager, Fundbox, will guide you through all the necessary steps:

  1. Legal Steps: finding a legal representative, applying for a Portuguese tax number, and opening a Portuguese bank account.
  2. Complete Investment: complete KYC package and make the transfer of the investment amount.
  3. Submit Golden Visa Application: prepare all documentation and complete application online.
  4. Trip to Portugal: schedule an appointment at the immigration office (SEF) in Portugal to have the biometrics of you and your family taken.
  5. Obtain Golden Visa: receive confirmation and get your Golden Visa card.
  6. Renewal: After 2 years you need to renew your Golden Visa Residence card.
  7. Citizenship: After 5 years of residency, you can apply for a Portuguese citizenship.

Is the Portuguese Golden Visa ending?

What do we know so far?

The Portuguese government announced on 16th February that they will be introducing changes to the Golden Visa programme as part of a larger housing reform plan. This could mean that the Golden Visa option will be completely discontinued, or at least modified to put in place more requirements for qualification.

When will these changes happen?

Earliest change can be implemented on 31st March 2023.

The government needs to follow a number of procedures before any changes come into force. The prime minister’s speech on 16th February triggered a month-long public hearing, which will conclude in a proposal sent to Parliament on 16th March. It then takes between 2 and 3 weeks for Parliament to accept the proposal. It is then up to the President to ratify the proposal, send it back for amendments or decide to consult the Constitutional Court.

Why the Golden Visa fund is the best option now?
  1. There will be a rush from investors to acquire property that will limit supply of good quality assets.
  2. The search for the right asset, and then legal conveyancing of the acquisition will be challenging to organize with such a limited timeframe.
  3. There is a high possibility that the Fund route to the Golden Visa programme will not be discontinued, as the main focus of the new bill is to make the housing market more accessible to local residents.
  4. Funds are government-regulated and managed by approved and regulated fund managers that control and overlook the safety of your investment.
  5. Funds have 0% capital gains tax, where real estate investment are subject to 28% capital gains tax.
  6. Onboarding can be done in as little as two weeks. Which makes Golden Visa via fund the most tax efficient and hassle-free option for investors looking to give their families the opportunity of an EU residency and passport after 5 years.
Can you still apply?

Until at least the 31st March 2023 you can still apply, following the existing Golden Visa procedure.

This means that you need to have physically done your investment, taken all administrative steps, and sent the application for you and all family members that would be benefiting from the programme.

Who Is Eligible for a Golden Visa in Portugal?

Any non-EU/EEA/Swiss national can apply for the Portugal Golden Visa, as long as they are above 18 years old and hold a clean criminal record in their home country and in Portugal.

Can my family take advantage of my Golden Visa?

The main Golden Visa applicant can extend his benefits to his immediate family. Immediate family is considered:

  • Spouse
  • Children under the age of 18
  • Children under the age of 26, dependent on the main applicant, and only if they are a full-time student and not married
Are loans allowed for the golden visa investment in Portugal?
Investors can take the amount as a loan from a non-Portuguese financial institution and then bring it into Portugal.
What about taxes?
The Golden Visa program does not bring any tax responsibility to you if you spend less than 183 days per year. Only if you spend more than 183 days per year, you will be considered a tax resident in Portugal.

Portugal offers favourable tax regime through the non-habitual residency (NHR) program. This offers exemptions from income tax for the first 10 years of residence.

Do I need to speak Portuguese?

There is no language requirement to obtain residency.

Speaking the local language creates a more immersive experience, however, the Portuguese are used to hosting foreigners, and English is widely spoken.

Should you wish to proceed with applying for citizenship after 5 years, a language test is required to show your knowledge is at A2 level of the European language framework. A2 corresponds to basic conversational command of the Portuguese language and there are many resources and classes available to help you prepare both in person and online.

Children under the age of 10 are exempt from doing the language test.

How long does it take to receive the residence permit?

After submission of all necessary documents, the process is expected to take up to 90 days. To have the cards in hand in your home country it is expected to take less than 150 days.
